1. Agreement to Terms

By accessing or using any services provided by Motion Investments LLC ("Motion," "we," "our," or "us"), including our website at motioninvestments.llc, our web application (the "Motion App"), and our Discord community, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

Motion Investments provides a crypto trading community, educational content, and planning tools. Our services include:

• Access to our Discord community for discussion and education
• The Motion App — a personal planning and trade journaling tool
• Educational content related to cryptocurrency trading and market structure
• Optional paid tiers with additional features

3. Not Financial Advice

Nothing provided by Motion Investments — including community discussions, educational content, trade ideas, market analysis, or any feature of the Motion App — constitutes financial, investment, tax, or legal advice. All content is for educational and informational purposes only. You are solely responsible for your own trading decisions and should consult a qualified financial advisor before making any investment.

4. Eligibility

You must be at least 18 years of age to use our services. By using our services, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

5. Account Registration

To access certain features, you may need to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@motioninvestments.llc if you suspect unauthorized access.

6. Acceptable Use

You agree not to:

• Use our services for any unlawful purpose
• Harass, abuse, or harm other community members
• Share, redistribute, or resell paid content or features
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use bots, scrapers, or automated tools to access our services without permission
• Impersonate Motion Investments, its staff, or other members

We reserve the right to suspend or terminate access for violations at our sole discretion.

7. Paid Services & Billing

Certain features may require a paid subscription. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. Cancellation takes effect at the end of the current billing period. Refunds are handled on a case-by-case basis. All fees are in USD unless otherwise stated.

8. Intellectual Property

All content, branding, code, and materials provided through our services are owned by Motion Investments LLC and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our content without written permission.

9. User Content

You retain ownership of content you create (such as trade journal entries and planner data). By using our services, you grant us a limited license to store and process your content solely to provide the services to you. We will not sell or share your personal content with third parties.

10. Third-Party Services

Our services may integrate with third-party platforms including Discord, Supabase, Stripe, Google, and CoinGecko. Your use of those services is governed by their respective terms and privacy policies. We are not responsible for third-party service availability or practices.

11. Assumption of Risk

Cryptocurrency trading involves substantial risk of loss and is not suitable for every person. You acknowledge that you may lose some or all of your invested capital. Past performance discussed in our community does not guarantee future results. Motion Investments is not liable for any trading losses you incur.

12. Limitation of Liability

To the fullest extent permitted by law, Motion Investments LLC, its members, partners, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to financial losses, data loss, or interruption of service.

13. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that our services will be uninterrupted, error-free, or secure.

14. Indemnification

You agree to indemnify and hold harmless Motion Investments LLC and its members from any claims, damages, or expenses arising from your use of our services or violation of these Terms.

15. Account Deletion

You may request deletion of your account and associated data at any time through the Motion App settings or by contacting support@motioninvestments.llc. Upon deletion, your data will be permanently removed from our systems.

16. Changes to These Terms

We may update these Terms from time to time. We will notify users of material changes via our Discord community or through the Motion App. Continued use of our services after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of the State in which Motion Investments LLC is organized, without regard to conflict of law principles.
